What uses are allowed under a Personal license?

Allowed Uses - Non-Commercial Only

Buyer can only use Seller’s Final Work for lawful purposes only—in other words, for stuff that doesn’t break the law.

Subject to payment, Buyer is granted a limited, non-exclusive, non-transferable, and non-sublicensable license, to use Seller’s End Product for the following Non-Commercial purposes with up to 1,000 End Users:

  • Digital products/services for Non-Commercial Use
  • Physical products/services for Non-Commercial Use:
  • Digital or print publications for Non-Commercial Use
  • Single (1) personal social media account for Non-Commercial Use:
  • Internet streaming of motion picture and audiovisual content for Non-Commercial Use.

What uses are prohibited with a Personal license?

Prohibited Uses

  • Any Commercial Use of Seller’s End Product (including, without limitation, physical or digital products and services, resale, sub-licensing, or digital/print publications) is not allowed.
  • Any use that breaks the law (including without limitation uses that are unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, doxxing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable);
  • If the End Product contains an image of a natural person, even if the End Product is model-released, Buyer can’t use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects;
  • On-demand applications (including but not limited to “print-on-demand”, “made to order”, create-on-demand, download on demand” services);
  • Company or business social media accounts;
  • Physical (printed, paid or unpaid) ads;
  • Digital (paid or unpaid) ads;
  • Broadcast use of motion picture and audiovisual content (including but not limited to network, cable, satellite, pay-per-view, video on demand, audio visual works);
  • Use in software for sale;
  • Use in trademarks, trade-names, service marks, or design marks;
  • Any use that falsely represents the End Product (or a modification or derivative thereof) as Buyer’s own copyright work;
  • Use in content Buyer does not have the necessary rights to use or reproduce, or in content Buyer knows is inaccurate;
  • Making public or sharing the End Product in any way that allows third-parties to download, extract, or redistribute the End Product;

Can my non-profit use Final Work with a Personal License?

No, the Personal License is only for use by individuals who are natural persons.

If the Seller has not opted to license under the Buyer Owns Rights license, your non-profit will need to purchase a limited or unlimited license from the Seller.

Can I use audiovisual Final Work for streaming under a Personal License?

So long as the use is for Non-Commercial purposes only and doesn’t break the law, then yes.

Subject to payment, Buyer is granted a limited, non-exclusive, non-transferable, and non-sublicensable license, to use Seller’s End Product for the following Non-Commercial purposes with up to 1,000 End Users:

  • Internet streaming of motion picture and audiovisual content for Non-Commercial Use.

Can I create eBooks on a Personal License?

So long as the eBook is for Non-Commercial purposes only and both the use and content of the eBook doesn’t break the law, then yes.

Subject to payment, Buyer is granted a limited, non-exclusive, non-transferable, and non-sublicensable license, to use Seller’s End Product for the following Non-Commercial purposes with up to 1,000 End Users:

  • Digital or print publications for Non-Commercial Use

Can I post the Final Work on social media with a Personal License?

Yes but on the strict conditions you only post the Final Work to ONE personal social media account for Non-Commercial purposes only, keep within a limit of 1,000 End Users, and the use doesn’t break the law.

Subject to payment, Buyer is granted a limited, non-exclusive, non-transferable, and non-sublicensable license, to use Seller’s End Product for the following Non-Commercial purposes with up to 1,000 End Users:

  • Single (1) personal social media account for Non-Commercial Use:

Can I create new products or derivatives of End Products with a Personal license?

Yes on the strict conditions the uses are Non-Commercial Only, kept within 1,000 End Users and do not break the law.

What does “Personal” mean?

The Buyer (Licensee) must be an Individual in terms of a natural living person, not a company or other legal entity, with a Personal License.
